Blended Family Estate Planning in Asheville
Planning for Spouses, Stepchildren & Children from Prior Relationships
A blended-family estate plan clarifies how your current spouse, children from prior relationships, stepchildren, and other intended beneficiaries fit into your wishes. At The Forest Law Group, we help Asheville families address inheritance, lifetime financial support, healthcare decisions, and the selection of trusted decision-makers.
Brian Lawler spent a decade in social services before law school. His work included mental health and disability services, foster care and adoption, and connections to community resources. That experience shapes our family-centered approach. Before drafting documents, we listen to your story and review your goals, family relationships, and financial circumstances.
Our work throughout Western North Carolina brings estate planning together with elder law, including asset protection and special needs planning. For blended families, we coordinate wills, trusts, and documents for financial and healthcare decisions.

North Carolina Inheritance Rules for Blended Families
Intestate succession controls inheritance when someone dies without a will. North Carolina applies a fixed legal formula rather than distributing assets according to personal relationships or undocumented wishes. The result depends on which relatives survive the person and the assets involved.
A surviving spouse may also have elective-share rights under North Carolina General Statute § 30-3.1. An elective share is the portion of a deceased spouse’s Total Net Assets that may be claimed when the estate plan provides less.
The elective-share percentage depends on the length of the marriage:
- 15% after less than five years of marriage
- 25% after five years but less than 10 years
- 33% after 10 years but less than 15 years
- 50% after 15 years or longer
The claim must be made within six months after letters testamentary or letters of administration are issued. It requires a verified petition filed with the clerk of superior court in the county where the estate is primarily administered.
A spouse may waive the elective share in whole or in part before or after marriage through a signed written waiver. How these rules affect your family depends on its circumstances and existing documents. We explain the relevant North Carolina estate laws so you can make informed planning decisions.

Coordinating Wills, Trusts & Incapacity Documents
Property and incapacity documents serve different purposes. Wills and trusts address distribution and administration after death, while powers of attorney and advance directives identify who can act and which preferences should guide decisions during life. We help you select and coordinate documents around your family and financial goals.
A blended-family plan may include:
- Wills: We draft wills that identify intended beneficiaries and state how property should pass after death.
- Revocable living trusts: A revocable living trust can work alongside a will to manage and distribute trust assets outside probate. Whether that structure fits depends on your family’s circumstances.
- Durable powers of attorney: We prepare documents authorizing trusted people to manage financial matters if you can’t act.
- Healthcare proxies: These documents name trusted people to make medical decisions if you can’t communicate or decide.
- Living wills and advance directives: We help you record end-of-life medical preferences so the people involved in your care can understand your wishes.
Second marriages often require careful coordination between support for a current spouse and future inheritances for children. We develop these provisions with you so each document works as part of a unified plan.
Our Blended-Family Estate Planning Process
Our first meeting is a conversation about your wishes, financial goals, healthcare priorities, and family relationships. We discuss who should benefit, which property the plan should cover, and who should make financial or medical decisions. You’ll have room to explain what matters before we recommend or draft documents.
We then build the estate plan with you around the circumstances it needs to address. We explain your choices in clear, practical language rather than confusing legal jargon. You’ll understand what each document does, why it belongs in the plan, and how the documents work together.
Your estate plan should continue to reflect your circumstances. Changes in your family, assets, or intentions may signal that it’s time to review existing documents.
